Automated Messages and Emails:

You will be receiving messages regarding your optin confirmation, booking confirmation and appointment reminders. Apart from this you will not receive any automated messages or emails.

Unsubscribe:

You can cancel the SMS service at any time. Simply text "STOP" to the shortcode. Upon sending "STOP," we will confirm your unsubscribe status via SMS. Following this confirmation, you will no longer receive SMS messages from us. To cancel the appointment. Simply text "Cancel" to the shortcode and you will receive a confirmation regarding your cancelled appointment.

Support:

As always, message and data rates may apply for messages sent to you from us and to us from you. You will receive 5 messages 36 prior the appointment and one each upon optin and appointment no-show/cancel. For questions about your text plan or data plan, contact your wireless provider.

These Terms & Conditions (“Terms”) govern the use of services offered by Built by Shah LLC (“Built by Shah,” “we,” “us,” or “our”) including websites, digital marketing services, software implementations, automations, consultations, and all custom-built deliverables provided to clients (“you,” “your”).

By engaging with Built by Shah LLC or using any of our Services, you agree to these Terms.

1. Services

Built by Shah LLC provides fully custom services including:

  • Website and landing page design

  • SEO, Google Ads, and digital marketing management

  • CRM setups and automations

  • Custom platform development and client account portals

  • Consultations and strategy sessions

Each service is scoped individually and is subject to the details outlined in the proposal, invoice, or project plan.

2. Payment Terms

  • All payments are processed via Stripe unless otherwise agreed upon.

  • One-time project fees and monthly retainers are billed according to the timelines defined in your invoice.

  • Monthly retainers are charged automatically unless canceled in writing at least 10 days before the next billing cycle.

  • Late payments may result in paused work, revoked access, or legal recovery of owed amounts.

3. Refund Policy

All sales are final and non-refundable.
Due to the custom nature of each project, no refunds will be issued once work has begun or payment has been processed, whichever comes first. This applies to both one-time projects and monthly services.

4. Project Timelines

Timelines provided are estimates and depend on client responsiveness and resource availability.
Delays in feedback, content delivery, or approvals from your side may result in adjusted timelines.
Built by Shah is not responsible for delays caused by client inaction.

5. Client Responsibilities

You agree to:

  • Provide accurate and timely information as requested

  • Review and approve deliverables within reasonable timeframes

  • Make decisions and provide feedback through designated points of contact

  • Ensure legal compliance of any content, materials, or data you supply

6. Ownership & Usage Rights

  • Upon full payment, ownership of completed deliverables (e.g., website files, ad creatives, automations) will transfer to you.

  • Built by Shah retains the right to showcase completed work in portfolios, case studies, or promotional content unless otherwise agreed upon in writing.

  • Any third-party tools or platforms used may have their own licenses or terms, which you agree to honor.

7. AI-Generated Content

Some services may involve content or functionality generated using third-party AI tools (including, but not limited to, OpenAI-based services). By using our Services, you acknowledge and agree:

  • AI-generated content is provided “as is” and should be reviewed before use

  • Built by Shah disclaims liability for any outcomes, inaccuracies, or decisions based on AI content

  • You accept full responsibility for reviewing and approving AI-generated outputs before using them in your business

8. Data Handling & Privacy

Built by Shah collects and stores project-related information necessary to deliver services.
Client data is stored securely and deleted once the business relationship ends or the account is deactivated.

9. Termination

We reserve the right to terminate services or access to accounts at any time if:

  • Payments are overdue

  • You violate these Terms

  • You engage in abusive, fraudulent, or illegal behavior

You may cancel services at any time by providing written notice. No refunds will be provided.

10. Limitation of Liability

Built by Shah LLC is not liable for:

  • Loss of revenue, business, or data

  • Errors caused by third-party services (e.g., Google, Meta, Stripe, hosting platforms)

  • Delays caused by client inaction or scope changes

  • Legal or financial consequences of your misuse of deliverables

In no event shall our total liability exceed the amount paid by you for the specific service in question.

11. Governing Law

These Terms shall be governed by and interpreted under the laws of the State of California, with venue in the County of Orange. Any legal dispute will be resolved in those courts.

12. Modifications

We reserve the right to update these Terms at any time. Continued use of our Services after updates means you accept the new Terms. You will be notified of significant changes via email or through your client account.
